TERMS AND CONDITIONS

THE GOLF VILLAGE SOMERSET WEST
These Terms and Conditions govern the use of The Golf Village Somerset West, operated by Aspire Sport Online (Pty) Ltd ("The Golf Village", "the Club", "we", "our" or "us").
By becoming a member, purchasing a Day Pass, participating in any activity, or using the Club's facilities, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions, as amended from time to time.
1. Membership
Membership commences on the selected start date and continues for the minimum membership term selected at sign up.
Upon expiry of the minimum term, membership automatically continues on a month-to-month basis unless cancelled in accordance with these Terms and Conditions.
Membership is personal to the member and may not be transferred, shared or assigned to another person.
2. Membership Fees
Membership fees are payable either by monthly debit order or by payment in full for an approved upfront membership. Monthly memberships are available by debit order only. No cash, EFT or any other payment method will be accepted for monthly membership fees.
A once-off Joining Fee is payable upon activation of a membership unless otherwise stated in a promotional offer.
An annual Membership Levy, equal to one month's membership fee, is payable in December each year or included within applicable upfront memberships.
Membership fees shall increase by ten percent (10%) annually, effective on the anniversary of the member's joining date.
Membership fees may also automatically adjust should a member move into a different age category.
Membership fees remain payable regardless of facility usage unless an approved membership freeze is in effect.
3. Membership Cancellation
Members may cancel their membership after completion of their minimum membership term by providing one (1) full calendar month's written notice.
No cancellation shall be deemed effective until confirmed in writing by The Golf Village.
Members wishing to cancel before completion of their minimum membership term will be liable for an early cancellation fee equal to fifty percent (50%) of the remaining contract value.
Cancellation requests will not be processed while a member's account remains in arrears. All outstanding amounts must first be settled in full.
Membership fees and debit orders remain payable until the expiry of the applicable notice period and the cancellation has taken effect.
4. Membership Freezing
Members may request to freeze their membership for a period of between one (1) and six (6) months.
Freeze requests must be submitted in writing and are subject to approval.
Memberships with outstanding arrears will not qualify for a freeze.
Any approved freeze period will extend the minimum membership term by the same duration.
5. Facility Access
Access to the Club is managed through The Golf Village mobile application using a unique QR code.
The Club reserves the right to refuse or suspend access where:
• membership fees are outstanding;
• capacity limits have been reached;
• health and safety requirements require closure;
• facility rules have been breached; or
• management reasonably believes suspension is necessary.
Suspension of access does not suspend membership fees unless an approved membership freeze is in place.
Children under the age of twelve (12) remain the responsibility of their parent or legal guardian while on the premises.
6. Facility Rules
All members and visitors agree to comply with the Club's operating rules and any instructions given by management or staff.
Without limitation:
• Alcohol is strictly prohibited on the driving range.
• Sharing of bays is not permitted.
• Members and visitors must conduct themselves in a safe and respectful manner at all times.
• Members and visitors may only hit golf balls from the designated hitting mats. Hitting from any grassed area is strictly prohibited.
• The Golf Village reserves the right to refuse entry to, or require any member, visitor, guest or child to leave the premises where their behaviour is considered unsafe, disruptive, abusive, offensive or detrimental to the enjoyment, safety or wellbeing of others. In such circumstances, no refund, credit or compensation shall be payable.
Management reserves the right to amend facility rules from time to time without amending these Terms and Conditions.
The Golf Village operates CCTV surveillance throughout the facility for security, safety, operational and verification purposes, including the verification of Hole in One Challenge prizes. By entering the premises, members and visitors acknowledge and consent to such recording, subject to applicable law.
7. Hole in One Challenge
7.1 Eligibility
The Hole in One Challenge is available exclusively to:
• valid Golf Village members; and
• customers who have purchased a valid Day Pass.
Participation is only permitted while the membership or Day Pass remains valid.
7.2 Entry
Participation in the Hole in One Challenge requires the separate purchase of official Hole in One Challenge balls from reception.
The Challenge may not be entered without a valid membership or Day Pass.
Only official Golf Village Hole in One Challenge balls may be used.
7.3 Playing Rules
All shots must be played from the designated hitting area towards the official Hole in One green.
A successful Hole in One is achieved only when an official Challenge ball comes to rest inside the designated cup.
7.4 Jackpot Prize
Subject to successful verification and compliance with these Terms and Conditions, the successful participant will receive the advertised jackpot applicable at the time the winning shot is played.
The advertised jackpot amount may be amended by The Golf Village from time to time without prior notice.
7.5 Verification
Any claim for a Hole in One jackpot is subject to verification by management using CCTV footage, staff observations and any other evidence deemed necessary.
No jackpot shall become payable until verification has been completed.
The Golf Village reserves the right to withhold payment while verification is underway.
Participants agree to cooperate fully with any investigation relating to a winning shot.
7.6 Prize Payment
Verified jackpot prizes will be paid within fourteen (14) business days following successful verification.
7.7 Disqualification
The Golf Village reserves the right to disqualify any participant who:
• attempts to manipulate the Challenge;
• breaches these Terms and Conditions;
• behaves dishonestly or fraudulently;
• tampers with equipment; or
• otherwise acts contrary to the spirit of the competition.
7.8 Assumption of Risk
Participation in the Hole in One Challenge is entirely voluntary and at the participant's own risk.
Participants acknowledge the inherent risks associated with golf activities and agree that The Golf Village, its directors, employees, contractors and sponsors shall not be liable for any injury, loss or damage arising from participation except where liability cannot lawfully be excluded.
7.9 Final Decision
The Golf Village's decision regarding eligibility, verification, qualification for the jackpot and interpretation of these Terms and Conditions shall be final.
7.10 Equipment Failure / Force Majeure
The Golf Village shall not be liable for any failure, suspension or cancellation of the Hole in One Challenge arising from circumstances beyond its reasonable control, including but not limited to adverse weather conditions, power failures, equipment malfunction, maintenance, acts of God, or any event affecting the safe operation of the Challenge.
7.11 Fraud and Misconduct
Any attempt to manipulate, interfere with or fraudulently influence the outcome of the Hole in One Challenge, including the use of unauthorised balls, equipment or conduct deemed dishonest by The Golf Village, shall result in immediate disqualification and may result in the participant being permanently banned from participating in future promotions.
7.12 Equipment Damage
Participants are responsible for using the facilities and equipment in accordance with The Golf Village's rules. Any intentional or negligent damage caused to the Hole in One equipment or surrounding facilities may result in the participant being held liable for the cost of repair or replacement.
7.13 Taxes
Any tax liability arising from the receipt of a jackpot prize shall be the sole responsibility of the winner.
7.14 Excluded Participants
Directors, employees, contractors, coaches, sponsors, promotional partners and any person directly involved in the administration of the Hole in One Challenge, together with their immediate family members may not participate in the Hole in One Challenge for jackpot prizes unless expressly authorised in writing by The Golf Village.
7.15 Right to Refuse Participation
The Golf Village reserves the right to refuse entry to or remove any participant whose conduct is unsafe, abusive, intoxicated or otherwise contrary to the interests of the Club or the fair operation of the Challenge.
7.16 Acceptance
By purchasing Hole in One Challenge balls and participating in the Challenge, participants acknowledge that they have read, understood and accepted these Terms and Conditions.
8. Limitation of Liability
The Golf Village, its directors, employees, contractors, sponsors and agents shall, to the fullest extent permitted by law, not be liable for any injury, death, loss, theft, damage or expense suffered by any person arising from the use of the facilities or participation in any activity, including the Hole in One Challenge, except where such liability cannot lawfully be excluded under South African law.
9. Protection of Personal Information
The Golf Village processes personal information in accordance with the Protection of Personal Information Act (POPIA).
By using the Club's facilities, members and visitors consent to the collection and processing of their personal information where reasonably necessary for the operation of the business.
Members and visitors further consent to photographs and video footage taken at the facility being used for marketing, promotional and social media purposes unless they notify management in writing that they object.
10. Amendments
The Golf Village reserves the right to amend these Terms and Conditions from time to time.
Updated Terms and Conditions will be published on the Club's website and shall become effective upon publication.
Continued use of the Club's facilities constitutes acceptance of the amended Terms and Conditions.
11. Entire Agreement
These Terms and Conditions constitute the entire agreement between The Golf Village and its members and participants in relation to membership, facility use and promotional activities. No verbal representation or statement by any employee or representative shall vary these Terms unless confirmed in writing by The Golf Village.
